1. INFORMATION FOR THE USER

Who is responsible for processing your personal data?

Asociación Observatorio de Derechos Humanos y Energía - ODHEN is the party RESPONSIBLE for processing the USER's personal data, and informs the USER that this data will be processed in accordance with EU Regulation 2016/679 of 27 April (GDPR) and Spanish Organic Law 3/2018 of 5 December (LOPDGDD).

Why do we process your personal data?

To maintain a business relationship with the user. The intended data processing operations are:

  • Sending commercial advertising communications by email, fax, SMS, MMS, social networks or any other electronic or physical means, present or future, that enables commercial communications. These communications will be carried out by the RESPONSIBLE PARTY and will relate to its products and services, or those of its collaborators or suppliers with whom it has reached a promotional agreement. In this case, third parties will never have access to personal data.
  • Carrying out market research and statistical analysis.
  • Processing requests, enquiries, responding to queries or any type of request made by the USER through any of the contact methods available on the RESPONSIBLE PARTY's website.
  • Sending the online newsletter about news, offers and promotions related to our activities.

On what grounds can we process your personal data?

Because the processing is legitimised under article 6 of the GDPR as follows:

  • With the USER's consent: sending commercial communications and the newsletter. In addition, sending commercial communications by electronic means (email, SMS, etc.) is governed by article 21 of the Spanish LSSICE, which requires the recipient's prior, express consent for this type of communication.
  • On the basis of the RESPONSIBLE PARTY's legitimate interest: carrying out market research, statistical analysis, etc., and processing requests, enquiries, etc. at the USER's request.

How long will we keep your personal data?

Data will be kept for as long as there is a mutual interest in maintaining the purpose of the processing, and in any case for the legally established periods: for data processed on the basis of consent (commercial communications and newsletter), until the USER requests its deletion; and for data processed to handle enquiries or requests, for as long as necessary to resolve them and, thereafter, for as long as legal liabilities could arise, in accordance with the limitation periods applicable under Spanish law. Once these periods have elapsed, the data will be deleted using appropriate security measures to ensure its anonymisation or complete destruction.

Who do we share your personal data with?

No disclosure of personal data to third parties is planned, except, where necessary for carrying out the purposes of the processing, to our service providers related to communications, with whom the RESPONSIBLE PARTY has signed the confidentiality and data processing agreements required by current Spanish privacy legislation.

What are your rights?

The USER has the following rights:

  • The right to withdraw consent at any time.
  • The right of access, rectification, portability and erasure of their data, and the right to restrict or object to its processing.
  • The right to file a complaint with the supervisory authority (www.aepd.es, Spain) if they consider that the processing does not comply with applicable regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By ticking the corresponding boxes and entering data into fields marked with an asterisk (*) on the contact form or presented in download forms, USERS expressly, freely and unambiguously accept that their data is necessary for the provider to handle their request, and that providing data in the remaining fields is voluntary. The USER guarantees that the personal data provided to the RESPONSIBLE PARTY is truthful, and takes responsibility for reporting any changes to it.

The RESPONSIBLE PARTY states that all data requested through the website is mandatory, as it is necessary to provide the USER with an optimal service. If not all data is provided, it cannot be guaranteed that the information and services provided will fully match the USER's needs.

3. SECURITY MEASURES

In accordance with current Spanish and EU data protection regulations, the RESPONSIBLE PARTY complies with all provisions of the GDPR and LOPDGDD regarding the processing of personal data under its responsibility, and specifically with the principles set out in article 5 of the GDPR, under which data is processed lawfully, fairly and transparently in relation to the data subject, and is adequate, relevant and limited to what is necessary for the purposes for which it is processed.

The RESPONSIBLE PARTY guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and the LOPDGDD, in order to protect the rights and freedoms of USERS, and has provided them with adequate information so they can exercise those rights.
